What are the grounds and residency requirements to file for an uncontested or "no-fault" divorce in New Jersey?

  1. At least one of the parties is currently a resident of New Jersey, and has remained a resident for at least the last 12 months.
  2. The parties agree on all details, or at least make no objections.
  3. A Marital Settlement Agreement (MSA) is required if either party is seeking alimony, and recommended if there are minor children involved.
  4. The spouse who is the Defendant in the divorce action is not an active member of the United States military.
    1. The parties have been separated and living apart (at different residential addresses) for at least the last 18 months, without any reconciliation.

    2. The parties agree that there are irreconcilable differences for at least the last 6 months, which have caused the breakdown of the marriage, and there is no potential of reconciliation.
